By accessing or using Vacant Kenya ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to all the terms, you may not access or use the Platform.

These terms apply to all visitors, users, and others who access or use the Platform. We reserve the right to update these terms at any time, and continued use of the Platform constitutes acceptance of any changes.

Vacant Kenya is an online marketplace that connects tenants and landlords directly for rental property listings in Kenya. The Platform facilitates:

• Listing of rental properties by current tenants and landlords
• Browsing and searching of available rental listings
• Direct communication between listers and prospective tenants
• Community-driven verification of listings
• Confirmation of taken properties

Vacant Kenya acts solely as an intermediary and is not a party to any rental agreement between users.

To use certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

Users may list rental properties on the Platform subject to the following conditions:

• Listings must be accurate and not misleading
• The lister must have the legal right to list the property
• Listing fees are non-refundable once the listing is published
• We reserve the right to remove listings that violate these terms
• Duplicate listings for the same property are not permitted

Certain features of the Platform require payment, including listing fees and hunt access passes. All fees are displayed clearly before purchase and are processed through secure third-party payment providers.

Fees are non-refundable except as expressly stated in our refund policy. We reserve the right to change our fees at any time, with notice to users.

All payments are processed in Kenyan Shillings (KES).

You agree not to:

• Post false, misleading, or fraudulent listings
• Use the Platform for any illegal purpose
• Harass, abuse, or harm other users
• Attempt to bypass our verification or payment systems
• Collect user data without consent
• Post listings for properties you do not have the right to list
• Use bots, scrapers, or automated tools to access the Platform
• Impersonate any person or entity

The Platform and its original content, features, and functionality are owned by Vacant Kenya and are protected by Kenyan and international copyright, trademark, and other intellectual property laws.

You may not modify, reproduce, distribute, or create derivative works based on our content without our express written permission.

Vacant Kenya provides the Platform on an "as is" and "as available" basis. We make no warranties, expressed or implied, regarding the accuracy, reliability, or availability of listings or user information.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. This includes, but is not limited to, damages for loss of profits, data, or other intangible losses.

Vacant Kenya is not responsible for the conduct of any user, whether online or offline, including but not limited to disputes between tenants and landlords.

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, your right to use the Platform will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions.

Any disputes arising from these terms shall be resolved through the courts of Kenya.
